Terms of Service

Effective: 31 October 2026 · Version: 2.8 · pr@premate.gg

These Terms of Service (“Terms”) set out the conditions under which you use the micup.gg service. Please read them carefully: by using the service, you accept these Terms, the Community Guidelines (Turkish) and the Privacy Policy.

1. Parties and acceptance

1.1. The micup.gg service is operated by O Group MMC (a Məhdud Məsuliyyətli Cəmiyyət (MMC) registered in Azerbaijan, Aslanbayli Village, Qazax, AZ3500, Azerbaijan, VÖEN 4202413611). In the rest of this text, “Micup” or “we” refers to this company operating the service, and “you” or “User” refers to the person using the service.

1.2. Acceptance. When creating an account, you declare that you have read and accepted these Terms. Your acceptance is recorded together with the version of the text you accepted. Merely viewing publicly available pages without opening an account is also subject to these Terms.

1.3. Entirety. These Terms form a single whole together with the Community Guidelines (Turkish), the Privacy Policy, the Child Safety Policy (Turkish) and the Legal Requests Guide (Turkish). In the event of a conflict between them, the Community Guidelines prevail on matters relating to user behaviour, and the Privacy Policy prevails on matters relating to personal data.

2. Definitions

3. Eligibility and age

3.1. You must be at least 15 years old to use the Service. We ask for your date of birth during registration, and you are required to state it accurately.

3.2. Ages 15–17. Users who have reached the age of 15 but are under 18 may use the Service with the knowledge and consent of their parent or guardian. By accepting these Terms, you declare that you have obtained the necessary consent. For their protection, stricter settings are applied by default to accounts of minors; content intended for adults and certain features are disabled. Details are in the Child Safety Policy (Turkish).

3.3. We close accounts that we learn belong to persons under 15 and delete their data. Opening an account by misstating your age is a breach of these Terms.

3.4. Banned users. A person whose account has been permanently banned may not return to the Service by opening a new account. Persons who fall within the scope of applicable sanctions decisions may not use the Service. If you open an account on behalf of a legal entity, you declare that you are authorised to represent that legal entity.

4. Account security and responsibility

4.1. You are responsible for the security of your account. Do not share your password with anyone; we recommend enabling two-step verification.

4.2. All actions performed with your account are deemed to be yours. If you suspect unauthorised access, you must change your password immediately and report it to pr@premate.gg.

4.3. You may not sell, rent or transfer your account. When we detect account trading, we close both accounts.

4.4. As a rule, each person opens a single account. Second accounts opened to evade enforcement action are closed.

5. Description of the Service and right to make changes

5.1. Micup is a community platform offering text chat, voice and video chat, screen sharing, servers, direct messages, clip sharing and feed features.

5.2. Voice and video chats are not recorded. Audio and video data are transmitted live between participants and are not stored on our servers. Text messages, however, are stored server-side so that we can provide the service, and are not end-to-end encrypted. An optional media protection mode is available for voice rooms; this mode covers only the audio and video stream, not chat messages.

5.3. We reserve the right to develop the Service and to add, change or remove features. We announce changes that materially affect most users within the Service a reasonable time in advance.

5.4. Usage limits. To keep the system stable and to prevent abuse, we apply numerical limits: these include limits on the number of servers that can be created per user (daily and in total), file size, message rate and request frequency. These limits may be adjusted without prior notice.

5.5. The Service relies on third-party infrastructure providers to operate. The current list of these providers is in the Privacy Policy.

5.6. Usage measurement. To improve the Service, we measure usage statistics in the web and desktop apps with Google Analytics. This measurement is on by default. What is sent: which page types are opened (not channel, server or person names or IDs), which features are used (such as sending a message or joining a voice room; not content), browser, operating system, device type, language, the country Google derives from your IP address, app version, web or desktop, only the domain of the site you came from, and campaign link tags. Your messages, username, email, and server and channel details are not sent; the data is not used for advertising. The data is transferred abroad (Google LLC, USA). You can turn the measurement off at any time: when signed in, in Settings › Privacy › Analytics cookies; when signed out, with the Turn off analytics cookies link at the bottom of the sign-in and registration pages. Turning it off stops the measurement and deletes the analytics cookies. Details: Privacy Policy 2.6 and 4.

6. Acceptable use

The following behaviour and content are prohibited. The list is illustrative; the fact that a behaviour is not listed here does not mean that it is permitted.

There is no tolerance for objectionable content or abusive users. Micup does not tolerate objectionable content or users who harass or abuse others. In these Terms, objectionable content means the content listed in 6.1 and 6.2, together with adult content, hate speech, harassment, bullying and doxxing (6.3). We review reports of such content within 24 hours at the latest; if we find a violation, within the same period we remove the content and eject the account that posted it from the Service by suspending or permanently banning it. You can report content and users to us with the Report button, block a user, and also report that user to Micup when blocking them or afterwards.

6.1. Zero tolerance

6.2. Catalogue offences under Turkish law

A significant portion of our users are in Türkiye. For this reason, content relating to the catalogue offences listed in Article 8 of Law No. 5651 (Türkiye's law regulating internet publications) is additionally and expressly prohibited within the Service:

We remove such content without waiting for a decision concerning us to be issued. Where technically possible and legally sufficient, we may choose to restrict access only from the relevant country instead of removing the content globally (see 19.3).

6.3. Other prohibited content and behaviour

6.4. Technical prohibitions

7. User Content and the licence granted to us

7.1. Content is yours. Ownership and intellectual property rights in the Content you share remain with you. These Terms do not transfer your rights to us.

7.2. The licence you grant. So that we can operate the Service, you grant us, in respect of the Content you share, a worldwide, royalty-free, non-exclusive licence of use that is sub-licensable only to our infrastructure providers. This licence is limited to hosting, copying, backing up, formatting, encoding, generating thumbnails, reviewing for moderation purposes and displaying the Content within the Service with the visibility you set.

7.3. Clips and public posts. For clips, posts and profile information that you share publicly, the licence also covers displaying them within the Service and on the Service's promotional surfaces (explore, highlights, link previews) and transmitting them through a content delivery network. This does not allow us to sell your Content outside the Service or to turn it into an advertising product.

7.4. End of the licence. The licence ends when you delete the Content. Purging it from backups and delivery network caches takes a reasonable time; records that must be retained by law and records subject to an ongoing investigation are excluded from this (see the Privacy Policy).

7.5. Representation and undertaking. You represent and undertake that you hold the necessary rights for every item of Content you share, that the Content does not infringe the rights of third parties, and that it complies with these Terms and the Community Guidelines (Turkish).

7.6. Feedback. We may freely use the suggestions and feedback you send us without incurring any obligation towards you.

8. Intellectual property

8.1. The Micup name and logo belong to Micup. Micup's software is built on Fluxer, the copyright in which belongs to Fluxer Platform AB and its contributors, and is licensed under the GNU Affero General Public License version 3 (AGPLv3); your rights to use, study, modify and distribute the software are set out in the AGPLv3, and the source code is on the Source Code (Turkish) page. These Terms govern the use of the Service and do not restrict your rights in the software under the AGPLv3.

8.2. You may not use our trademarks and logos, without our written permission, in a way that causes confusion or gives the impression that you are affiliated with us.

8.3. Game names, game images and third-party trademarks appearing within the Service belong to their respective rights holders.

8.4. The emoji graphics shown in the Service are taken from the Twemoji project (copyright © Twitter, Inc. and other contributors) and are used under the CC BY 4.0 licence. Emoji names and keywords are derived from Emojibase data (MIT licence).

9. Moderation and enforcement rights

9.1. No general monitoring obligation. We are not required to review User Content generally before it is published, and we make no such commitment. This does not remove our right and obligation to act against unlawful content of which we have knowledge.

9.2. Enforcement tools. In the event of a breach of these Terms, the Community Guidelines or applicable law, we may apply the following measures depending on the severity and repetition of the breach:

9.2.1. Requests by platform and store operators. In addition to applicable law, we also remove or disable access to User Content when the operator of a platform or app store through which the Service is distributed (for example, Microsoft Store) requests it under its rules.

9.3. No prior warning required. As a rule, enforcement actions are applied progressively; however, for violations under 6.1 and 6.2 and for repeated serious violations, a permanent ban is applied directly without a warning. For the other objectionable content and harassment violations defined at the start of section 6, no warning stage applies either; the content is removed and the account is suspended or permanently banned.

9.4. Automated systems. Some violations are detected by automated systems, and enforcement action may be applied instantly, without human review. These systems are:

9.5. Appeal. You may appeal any enforcement action taken against you. Send your appeal to pr@premate.gg within 7 days of being notified of the decision, stating your account name and your explanation regarding the decision. Your appeal is reviewed by a human, independently of the automated system that made the decision, and the outcome is communicated to you with reasons. In decisions relating to child sexual abuse, an appeal does not lead to the ban being lifted; only claims of mistaken identity are reviewed.

9.6. Moderation within Servers. Server Owners may set additional rules in their own spaces, define roles and permissions, remove members and set up automated moderation. Server rules cannot relax these Terms or the Community Guidelines. A Server Owner is responsible for unlawful content in their own Server from the moment they become aware of it.

10. Reporting and removal

10.1. When you come across content that is unlawful or breaks the rules, use the Report button next to the content or write to pr@premate.gg. Our review times are published in the Community Guidelines (Turkish).

10.2. Content of the report. Your report must include: the link to or location of the reported content (server, channel, message), the nature of the violation and your contact details. For a copyright claim, a statement that you are the rights holder and an undertaking that your statement is accurate are also required. We may request additional information for incomplete reports.

10.3. Copyright. Upon copyright infringement reports, we remove the content and inform the user who uploaded it. The accounts of repeat infringers are closed.

10.4. Counter-notice. If your content was removed following a third-party report, you may send pr@premate.gg a counter-notice explaining that the content is lawful and that you hold the necessary rights. We assess the counter-notice and, if we find it justified, we restore the content. We are not an authority that resolves rights disputes between the parties.

10.5. Abuse. Knowingly making false reports or using the reporting system as a tool for silencing others is a breach of these Terms and is subject to enforcement action.

11. Micup Plus, cosmetic items and payments

11.1. Products. Micup Plus is a digital service that unlocks additional features on your account for the duration of the package you purchase (1, 3 or 12 calendar months). Micup Visionary is a package sold in limited numbers on a one-time basis while it is on sale; for as long as the Micup service continues, it provides the Micup Plus features, a numbered Visionary badge and cosmetic items given only to Visionary holders. Cosmetic items are digital appearance items assigned to your account when purchased. No physical product is shipped. Plus time and cosmetic items can be used only on the account on which they were purchased; they cannot be transferred to another account or converted into money. Unless stated otherwise, what this section says about Plus also applies to Visionary.

11.2. One-time package and automatically renewing subscription. Micup Plus can be purchased in two ways:

Cosmetic items and Micup Visionary are purchased on a one-time basis only. Your card details are not stored by us; for a subscription, your payment method is stored by Paddle, and for a Google Play subscription, in your Google account.

11.2.1. Renewal and charging. At the end of the period you chose (1, 3 or 12 months), the subscription renews automatically for the same length of time and continues until you, or Paddle or we under 11.2.4 and 11.2.5, cancel it. At each renewal, the period amount you confirmed at your first purchase is charged by Paddle, in the same currency, to the payment method you used for the first payment or have updated since, on or after the day the period renews. The next charge date is shown in the application under Settings › Micup Plus. Paddle sends a reminder before renewal where the law of your country requires it.

11.2.2. Price. The subscription is offered at the normal list price at the time of purchase; campaign discounts do not apply to it. The period amount, currency and period length are set at your first purchase. If the price list, a campaign or the exchange rate changes later, the amount of your existing subscription does not change. A different amount or period requires the existing subscription to be cancelled and the new offer to be expressly confirmed.

11.2.3. Cancellation. You can cancel the subscription at any time under Settings › Micup Plus, through the management link in Paddle's email or at paddle.net. Cancellation takes effect at the end of the period you have paid for; Plus continues until that date and you are not charged for anything after it. You can undo the cancellation in the same section before the period ends. Cancellation is not a refund on its own; you can ask for a refund of your last payment separately under 11.5.

11.2.4. Payment problems. If a renewal payment cannot be taken, Paddle tries the payment again. While a renewal is being processed, Plus stays on for up to 6 hours after the end of the paid period; this is not extra free time, only time for the confirmation of the renewal to arrive. If the payment is not taken, Plus ends at the end of the period that Paddle has confirmed as paid; it is not provided for a period that has not been paid for, and it continues once the payment is taken. If Paddle cannot take the payment, it may cancel the subscription and tells you by email. You can update your payment method under Settings › Micup Plus.

11.2.5. Ending of the subscription by us. If a subscription payment is refunded or reversed by a chargeback, the Plus time for that payment's period is removed and the subscription is cancelled at once; you are not charged for later periods. If a second subscription is opened on the same account, or an amount, currency or period other than the one you confirmed on the checkout screen is charged, that subscription is also cancelled at once and we refund the extra payment. If you request the deletion of your account, or your account is closed under section 17 and scheduled for deletion, the subscription is cancelled at that moment to end with the paid period, and you are not charged for later periods; 11.7 and section 18 apply to the remaining time. These cancellations cannot be undone from the account; if you withdraw a deletion request, you can start a new subscription after the period ends.

11.2.6. Eligibility and scope. An account can have only one subscription at a time. A new subscription cannot be started while your account has unexpired Plus time (such as a one-time package or a gift) or Micup Visionary; a subscription is not added on top of existing time. One-time Plus cannot be purchased while a subscription is running, or before the paid period of a cancelled subscription has ended. Subscriptions are offered in countries where Paddle sells. Clauses 11.2.1 to 11.2.5 apply only to those who purchase an automatically renewing subscription; the terms of one-time purchases do not change.

11.2.7. Google Play subscription (Android). In the Android application installed from Google Play, Micup Plus is sold only through Google Play, as a monthly or yearly automatically renewing subscription; one-time Plus packages, the 3-month subscription, cosmetic items and Micup Visionary are not sold in that application. For this subscription, the seller is the Google Play developer named in 11.3; Google Play takes the payment and the Google Play Terms of Service also apply to the transaction. Clauses 11.2.1 to 11.2.6 do not apply to it (except the rule that an account can have only one subscription at a time); the following apply instead:

11.3. Payment. The payment provider through which a purchase is made is shown on the payment screen and on your receipt. For purchases made through Paddle, the seller is Paddle (Paddle.com Market Limited and the relevant Paddle companies), acting in its capacity as Merchant of Record. Paddle handles the payment, the invoice and the taxes; Paddle's buyer terms also apply to the transaction. For purchases made through Google Play, the seller is Asim Abdullazade, the holder of the personal developer account that publishes on Google Play under the name Eph Games (ASLANBƏYLİ KƏNDİ, Qazax, Azerbaijan; info@premate.gg); O Group MMC is not the seller of these purchases. Google (Google Payments) collects the payment and Google sends the receipt. In the countries Google specifies, such as the European Economic Area and the United Kingdom, Google handles the sale as the seller's agent, acting as Merchant of Record. On Google Play, the price is shown in the local currency of the country you are in; the final amount and any taxes are shown on the Google Play payment screen before you confirm. Micup is the party that provides the product and delivers it to your account. On Paddle, list prices are in US dollars; the final amount you will pay, the currency and any VAT or sales tax are shown on the Paddle checkout screen, according to the country you are in, before you confirm. Your card number, expiry date and security code never reach Micup's servers.

11.3.1. Transition period. Until the transition to Paddle is complete, some purchases continue to be taken in Azerbaijani manat (AZN) through Payriff, a payment institution established in Azerbaijan; for these purchases, the seller is Micup. For these payments, the Turkish lira (TL) amounts shown in the application are informational amounts calculated using the official daily exchange rate of the Central Bank of Azerbaijan (CBAR); the amount charged is in AZN. The TL amount appearing on your card statement may differ from the TL amount shown in the application because of the exchange rate of the bank that issued the card and any foreign transaction or commission fees that bank may apply. This difference is not within Micup's control.

11.4. Price changes. We may change prices. A change applies only to new purchases and does not affect the period you have already paid for. For an automatically renewing subscription, 11.2.2 applies, and for a Google Play subscription, 11.2.7.

11.5. Right of withdrawal and refunds. You get a full refund for any order you ask to refund within 14 days of the purchase date; the way to apply is set out in the Refund Policy. For an automatically renewing subscription, each renewal payment is a separate purchase and the 14 days run from that payment's date. If a subscription payment is refunded, 11.2.5 applies.

In cases of technical failure, duplicate charges or delivery of the wrong product, regardless of which provider you paid with, we refund; if you prefer, we correct the delivery. Your rights arising from consumer legislation that cannot be excluded by contract are reserved in all cases.

11.6. Chargebacks. If you have a problem with a payment, please contact us or the payment provider shown on your receipt before starting a dispute through your bank. Your right to raise a lawful dispute with your bank or payment provider is reserved. When a chargeback is recorded for a payment (for Paddle orders, when Paddle notifies us; for Payriff orders, when we process it), the Micup Plus time, the cosmetic items purchased on or after 18 October 2026 and the boosts given by that payment are removed from your account, a subscription payment's subscription is cancelled at once under 11.2.5, and your account's new purchases are blocked at once. While purchases are blocked you can still cancel a subscription; new purchases, undoing a cancellation and updating the payment method are not possible. If the chargeback is later reversed or decided in your favour, the block and the removed items do not come back by themselves; write to pr@premate.gg and we can review it and turn purchases back on. If the refund process is used again and again (for example, repeatedly buying the same kind of product and refunding it shortly after), we may restrict new purchases on your account; this does not affect refunds already given or your 14-day refund right.

11.7. Account closure and payments. If your account is closed because of a breach of the rules, the remaining Micup Plus time and cosmetic items purchased on or after 18 October 2026 end with the account. Your right to ask for a refund within 14 days of the purchase date (11.5) and your mandatory consumer rights are reserved.

12. Third-party services and links

12.1. The Service may contain links to third-party sites, embedded content and external services such as GIF search. We are not responsible for the accuracy, security or lawfulness of this content.

12.2. The desktop application automatically downloads and installs its updates; this is necessary for security patches to reach you.

13. Virtual items, badges and rankings

Badges, frames, level indicators, points and similar virtual items within the Service have no monetary value, are not the subject of ownership and cannot be converted into cash. You may not sell, transfer or trade them. When the Service ends or your account is closed, virtual items end without compensation.

14. Service provided “as is”

14.1. The Service is provided in its current state and “as is”. We make no express or implied commitment that it will operate without interruption, without errors or in a way fit for a particular purpose.

14.2. The Service may be temporarily unavailable due to maintenance, faults, attacks, outages caused by infrastructure providers or mandatory legal intervention. We take regular backups against data loss; nevertheless, we do not undertake that we will be able to recover lost data.

14.3. We make no commitment regarding the accuracy, reliability or lawfulness of User Content. Your interactions with other users are your own responsibility.

15. Limitation of liability

15.1. To the maximum extent permitted by applicable law, we are not liable for indirect damages, loss of profit, loss of reputation, loss of data or loss of use.

15.2. In any event, our total liability may not exceed the greater of the amount you actually paid us in the twelve months before the date on which the claim arose and USD 100.

15.3. This section does not cover damages arising from our intent, our gross negligence or cases of liability that cannot be limited by law. Your rights as a consumer that cannot be excluded by contract are reserved.

16. Indemnity

You agree to hold us harmless against claims, lawsuits, penalties and costs (including reasonable attorneys' fees) brought against us by third parties or official authorities because of your breach of these Terms, the Content you share or your unlawful use of the Service, and to compensate any loss that results. In the event of such a claim, we will inform you and cooperate to a reasonable extent in the conduct of the defence.

17. Suspension and termination

17.1. We may suspend your account or terminate the agreement in the event of a breach of these Terms, suspected unlawfulness, a payment dispute or a threat to the security of the Service.

17.2. In the event of termination, where possible and not legally prohibited, we notify you of the reason and indicate the appeal route (see 9.5).

17.3. You may end the agreement at any time by closing your account.

17.4. Sections 7 (the part concerning the end of the licence), 8, 13, 15, 16, 19, 20 and 22 remain in force after termination.

18. Account deletion and what happens to your data

18.1. You can delete your account yourself under Settings › Account. Deletion cannot be undone and requires two-step confirmation.

18.2. After deletion, your profile is removed, the authorship link of your posts is severed so that they are anonymised, and your files are cleared from storage. For Servers you own, you are offered the option to transfer or close them before deletion.

18.3. The copies held by other users of direct messages you sent to them are not deleted, because they form the recipient's own correspondence record; the author information is anonymised.

18.4. Records that must be retained by law (traffic records, payment and accounting records, moderation decisions) and records subject to an ongoing investigation are retained for the periods specified in the Privacy Policy.

18.5. Before deleting, you can download a copy of your data through Settings › Account › Prepare my data.

19. Compliance with legal requests and geographic restriction

19.1. Upon a duly made request from a competent court, public prosecutor's office, regulatory authority or law enforcement unit, we may preserve information in our possession, remove content, restrict access and share the requested data with the relevant authority.

19.2. Emergencies. If we reasonably conclude that there is an imminent and serious danger to a person's life or physical integrity, we may share information with the competent authorities without waiting for a formal request. For content relating to child sexual abuse, reporting is not a choice but a rule we apply.

19.3. Geographic restriction. If content is unlawful only under the law of a particular country, we may choose to restrict access only from that country instead of removing it globally.

19.4. Which authority may request what and on which legal basis, which data is provided under which decision, and whether you will be notified, are explained in detail in the Legal Requests and Law Enforcement Guide (Turkish).

19.5. You are responsible for complying with the law of the country in which you use the Service. You may not use the Service for a purpose that is prohibited in the country where you are located.

20. Governing law and competent courts

20.1. These Terms and disputes arising from them are governed by the law of the Republic of Türkiye.

20.2. For disputes arising from consumer transactions, the Consumer Arbitration Committees at your place of residence or at the place where the transaction was made have jurisdiction within the monetary limits set by Law No. 6502 on the Protection of Consumers (Tüketicinin Korunması Hakkında Kanun); for disputes exceeding these limits, the Consumer Courts at your place of residence have jurisdiction.

20.3. This section is without prejudice to the rights granted to you by the consumer legislation of the country in which you are located that cannot be excluded by contract. For users in Türkiye, the mandatory provisions of consumer legislation and the obligations under Law No. 5651 are reserved.

21. Changes and notices

21.1. We may update these Terms. The effective date and version of the current text are shown at the top of the page.

21.2. We announce material changes within the Service a reasonable time before they take effect. Continuing to use the Service after the announcement means that you accept the updated Terms. If you do not accept them, you may close your account. Changes that apply only to new purchases or that are in your favour (for example, a new payment provider, an additional refund right or the addition of operator information) may take effect on the date they are published.

21.3. Method of notice. Notices to you are given within the Service and/or to the email address registered to your account. You are responsible for keeping your email address up to date. Notices to us are to be sent to pr@premate.gg.

22. Other provisions

22.1. Severability. If a provision is held invalid or unenforceable, this does not affect the validity of the other provisions; the invalid provision is deemed to be replaced by the valid provision closest to its purpose.

22.2. Waiver. Our failure to exercise a right, or our delay in exercising it, does not mean that we have waived that right.

22.3. Assignment. You may not assign your rights and obligations under this agreement without notifying us. Micup may assign this agreement if the service is transferred to another person or company.

22.4. Entire agreement. These Terms, together with the texts listed in 1.3, constitute the entire agreement between the parties and supersede prior understandings on the same subject.

22.5. Force majeure. We are not liable for delays and disruptions arising from causes beyond our control, such as natural disasters, war, large-scale infrastructure outages, cyberattacks or decisions of official authorities.

22.6. Language. The Turkish version of this text is authoritative. If it is translated into another language and a conflict arises, the Turkish text applies.
